Privacy Policy

Preamble

We are very pleased that you are visiting our website and thank you for your interest in our company, the products and services we provide. The protection of your privacy and your personal data is important to us. In order to guarantee you the highest possible degree of transparency and security, our data protection declaration below informs you about the nature, scope and purpose of the collection, use and processing of the information and data collected by us.

Scope of application

This privacy policy only applies to the publicly accessible web pages of Thinking Networks AG. Our software solutions for desktop and web applications may have their own, deviating privacy statements; we will inform you within these applications about the storage and use of your personal data.

Our data protection principles

  • We handle the data transferred to us in a trustworthy and responsible manner and observe the statutory provisions on data protection, in particular the German Federal Data Protection Act (BDSG).
  • Personal data is only collected by us if and to the extent that you yourself provide it to us with your knowledge.
  • We do not sell, lend or give away your personal data. We only pass on your data to third parties without your consent if we are legally entitled to do so, e.g. in the event of a corresponding court order.
  • We use state-of-the-art security technologies to protect your data from misuse.

Data collection and storage

When you access our website a connection with our server is established. The access paths of the pages, the time of the establishment of the connection as well as your current IP address are collected and stored for the prevention of malfunctions and problems. During your visit to our website, data (“cookies”) may be stored on your computer to facilitate your use of our offer. We do not use this data to identify you or to contact you.

Personal data and their intended use

Personal data is collected and stored exclusively in accordance with the statutory provisions of the German Federal Data Protection Act (BDSG) and the German Telemedia Act (TMG). We store and use your personal data (name, address, e-mail address, bank details, etc.) to process your orders and any returns, for individual product support and, if desired, for our newsletter and product information.

We do not pass on your personal data to third parties. Exceptions to this are our service partners who require your data for order processing, such as parcel and mail delivery companies, printing companies and our banks (for the collection of direct debits). Your data will only be passed on to third parties if and to the extent that it is legally permissible or necessary for the assertion and enforcement of our rights and claims.

Information

You may at any time request information free of charge about your data stored with us or request correction, blocking and deletion of your stored data and its processing. If legal, contractual or commercial or tax retention periods or other legally anchored reasons prevent deletion, your data will not be deleted but blocked. To do so, please contact our data protection officer in writing at Thinking Networks AG, André Maslo, Markt 45-47, 52062 Aachen; by telephone at 0241 47072 - 0; by e-mail at andre.maslo@thinking-networks.com.

Changes to the data protection regulations

We reserve the right to adapt this information on data protection at any time in compliance with the data protection regulations.

Use of web analysis tools and display of usage-based advertising

Why web analytic tools?

We want to constantly improve our services, keep them up to date with the latest technology and provide you with a safe, smooth, efficient and personal user experience. For this purpose, we evaluate general information such as the number and duration of calls to our web pages and the Internet browsers used for this purpose in accordance with the following points.

To ensure that you only receive ads that may be relevant to you and that really appeal to you, we use cookies to collect information about the things that interest you. This can be, for example, the website you visit. These cookies do not increase the amount of advertising shown to you, only its relevance to you.

Google Analytics

Our website uses Google Analytics, a web analytics service provided by Google, Inc (“Google”). Google Analytics uses “cookies”, which are text files placed on your computer, to help the website analyze how users use the site. The information generated by the cookie about your use of this website is usually transmitted to a Google server in the USA and stored there.

  • In the event that IP anonymization is activated on this website, however, your IP address will be pre-shortened by Google within member states of the European Union or in other contracting states to the Agreement on the European Economic Area. We have activated IP anonymization for our service.
  • We have entered into an order processing agreement with Google to ensure that your data is handled in a data protection-compliant manner.
  • Only in exceptional cases will the full IP address be transferred to a Google server in the USA and shortened there. On behalf of the operator of this website, Google will use this information for the purpose of evaluating your use of the website, compiling reports on website activity and providing other services relating to website activity and internet usage to the website operator.
  • Google may link personal data from one service with information and personal data from other Google services. Depending on your account settings, your activities on other websites and in apps may therefore be linked to your personal data in order to improve Google’s services and advertising displayed by Google.
  • You may refuse the use of cookies by selecting the appropriate settings on your browser, in which case you may not be able to use the full functionality of this website. You can also prevent the collection of data generated by the cookie and related to your use of the website (including your IP address) to Google and the processing of this data by Google by downloading and installing the browser plugin available at the following link: https://tools.google.com/dlpage/gaoptout?hl=de
  • You can prevent the collection by Google Analytics by clicking on the following link. An opt-out cookie will be set to prevent future collection of your data when visiting this website:
    Disable Google Analytics

Google Dynamic Remarketing

This website uses the remarketing function of Google Inc. The function is used to present interest-based advertisements to website visitors within the Google advertising network. A so-called “cookie” is stored in the browser of the website visitor, which makes it possible to recognize the visitor when they visit websites that belong to the Google advertising network. On these pages, the visitor can be presented with advertisements that relate to content that the visitor has previously accessed on websites that use Google’s remarketing function.

According to its own information, Google does not collect any personal data during this process. If you nevertheless do not wish to use Google’s remarketing function, you can generally deactivate it by making the appropriate settings at https://www.google.com/settings/ads. Alternatively, you can deactivate the use of cookies for interest-based advertising via the advertising network initiative by following the instructions at https://www.networkadvertising.org/managing/opt_out.asp.

Google AdWords Conversion Tracking

As an AdWords customer, we use Google Conversion Tracking. If you have accessed our website via an ad placed by Google, Google AdWords will set a cookie on your computer. The cookie for conversion tracking is set when a user clicks on an ad placed by Google. These cookies lose their validity after 30 days and are not used for personal identification. If the user visits certain pages of our website and the cookie has not yet expired, we and Google can recognize that the user clicked on the ad and was redirected to this page. Each Google AdWords customer receives a different cookie. Cookies can therefore not be tracked across AdWords customers’ websites. The information obtained using the conversion cookie is used to create conversion statistics for AdWords customers who have opted for conversion tracking. The customers are told the total number of users who clicked on their ad and who were redirected to a page tagged with a conversion tracking tag. However, they do not receive any information that can identify users personally.

If you do not wish to participate in the tracking, you can refuse the setting of a cookie required for this - for example, via a browser setting that generally deactivates the automatic setting of cookies or set your browser so that cookies from the domain “googleleadservices.com” are blocked. Please note that you can not delete the opt-out cookies as long as you do not want any measurement data to be recorded. If you have deleted all your cookies in the browser, you must set the respective opt-out cookie again.

Google Tag Manager

Google Tag Manager is also a product of Google Inc, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (“Google”), which allows us to manage website tags from applications such as Google Analytics through one interface. The Tag Manager is a cookie-less domain and does not collect any personal data.

Integration of Taboola-Pixel

A visitor pixel and cookies of Taboola Inc, 28 West 23rd St, 5th fl, New York, NY 10010, USA are used on the advocado website for conversion measurement within the scope of legitimate interest according to Art. 6 para. I lit f DSGVO. This allows the behavior of users to be tracked after they have been redirected to the provider’s website by clicking on a Taboola ad. This procedure is used to evaluate the effectiveness of the Taboola advertisements for statistical and market research purposes and can help to optimize future advertising measures. The data collected is anonymous for us, so it does not allow us to draw any conclusions about the identity of the users. You can object to tracking by Taboola at any time; to do so, click on the “Reject” (opt-out) field under Taboola’s privacy policy, available at https://www.taboola.com/de/privacy-policy. Here you can also obtain further information on the data protection of Taboola Inc. The opt-out only applies to the device used by you in each case and also loses its validity when you delete your cookies. A erasure of the data transmitted in this way takes place within 3 months.

Use of Pendo

QVANTUM uses hashed and thus anonymous user IDs when using Pendo, which do not allow any conclusions to be drawn about you in person for this service provider. The data is only processed within the European Union. We have concluded an order processing agreement with Pendo order processing agreement. You can find more information about Pendo here.

Integration of social network plug-ins

Why social plugins?

We would like to reach as many interested parties as possible and therefore use social plugins on our websites to reach social networks such as Facebook and Twitter. To ensure that this does not happen unintentionally, these buttons must first be activated by you. As usual, we also inform you about the data transfer by displaying a notice next to these buttons.

Social media/social networks

We offer links or plugins for sharing the content of our online offers via social networks. You can recognize the links by the respective logo of the provider. Before calling up the corresponding links or plugins, no personal information is transmitted to the respective providers, as we use the data protection-friendly 2-Click or Shariff solution.

Thus, a Shariff button establishes direct contact between the social network and the visitor only when the visitor actively clicks on the Share button. Shariff thus prevents you from leaving a digital trail on every page you visit and improves data protection. By using Shariff, we can protect your personal data and still integrate social sharing buttons. For more information on c’t Shariff, please visit https://www.heise.de/ct/artikel/Shariff-Social-Media-Buttons-mit-Datenschutz-2467514.html.

We also offer online services on various social media platforms in order to provide information there and in order to be able to contact you.

We have no influence on the processing of personal data by the respective platform operator. Generally, when you visit our social media offerings, cookies are stored in your browser by the platform operator, in which your usage behavior or interests are stored for market research and advertising purposes. The processing of your personal data when visiting one of our social media offers is based on our legitimate interests in a diverse external presentation of our company and the use of an effective information resource as well as the ability to communicate with you.

The legal basis for this is Art. 6 (1) lit. f DSGVO. Under certain circumstances, you may also have given a platform operator consent to data processing, in which case Art. 6 (1) lit. a DSGVO is the legal basis. Detailed information about data processing in connection with the use of our social media offerings, opt-out options and the assertion of information rights can be found in the privacy policy of the relevant platform operator.

Facebook

This online offer uses plugins of the social network facebook.com, which is operated by Facebook Inc, 1601 S. California Ave, Palo Alto, CA 94304, USA (“Facebook”). An overview of the Facebook plugins and their appearance can be found at https://developers.facebook.com/docs/plugins/. When you call up a website that contains such a plugin, your browser establishes a direct connection with Facebook’s servers. The content of the plugin is transmitted by Facebook directly to your browser, which then integrates it into the website. By integrating the plugins, Facebook receives the information that your browser has accessed the corresponding page of our website, even if you do not have a Facebook account or are not currently logged in to Facebook. This information (including your IP address) is transmitted by your browser directly to a Facebook server in the USA and stored there.

If you are logged in to Facebook, Facebook can directly assign your visit to our website to your Facebook user account. If you do not want Facebook to assign the data collected via our website to your Facebook user account, you must log out of Facebook before visiting our website. If you interact with the plugins, for example by clicking the “Like” button or posting a comment, the corresponding information is also transmitted directly to a Facebook server and stored there. The information is also published on Facebook and displayed to your Facebook friends. The purpose and scope of the data collection and the further processing and use of the data by Facebook, as well as your rights in this regard and setting options for protecting your privacy, can be found in Facebook’s privacy policy (https://www.facebook.com/about/privacy/).

Use of Hubspot

Our website uses HubSpot, a software of HubSpot Inc, USA. This is an integrated software solution that we use to control and optimize our email marketing, in particular through so-called workflows.

HubSpot works with cookies to enable recognition and to allow us to personalize our communication with you.

If you generally do not want HubSpot to collect data, you can prevent the storage of cookies at any time by changing your browser settings accordingly.

HubSpot, Inc. participates in the EU-US Privacy Shield agreement and is certified for its compliance. To regulate the transfer of data, the EU standard contractual clauses have also been concluded between us and HubSpot. For more information on “HubSpot and data protection”, please visit: http://legal.hubspot.com/de/privacy-policy.

Contact: HubSpot, 2nd Floor 30 North Wall Quay, Dublin 1, Ireland, Phone: +353 1 5187500.

Twitter

This online offer uses the Twitter button from twitter.com, which is operated by Twitter Inc., 795 Folsom St., Suite 600, San Francisco, CA 94107 (“Twitter”). When you visit a website that contains such a plugin, your browser establishes a direct connection with the servers of Twitter. The content of the plugin is transmitted by Twitter directly to your browser and integrated by it into the website. By integrating the plugins, Twitter receives the information that your browser has called up the corresponding page of our website, even if you do not have a Twitter account or are not currently logged into Twitter. This information (including your IP address) is transmitted by your browser directly to a Twitter server in the USA and stored there. If you are logged in to Twitter, Twitter can directly assign your visit to our website to your Twitter user account. If you do not want Twitter to assign the data collected via our website to your Twitter user account, you must log out of Twitter before visiting our website. If you interact with the plugins, for example by clicking the “Tweet” button or posting a comment, the corresponding information is also transmitted directly to a Twitter server and stored there. The information is also published on Twitter and displayed to your followers. For the purpose and scope of the data collection and the further processing and use of the data by Twitter, as well as your rights in this regard and setting options for protecting your privacy, please refer to the privacy policy of Twitter (https://twitter.com/privacy).

LinkedIn

Plugins of the social network LinkedIn of LinkedIn Corporation, 2029 Stierlin Court, Mountain View, CA 94043, USA (hereinafter “LinkedIn”) are integrated on this website. You can recognize the LinkedIn plugins by the LinkedIn logo or the “Share button” (“Recommend”) on this website. When you visit this website, a direct connection between your browser and the LinkedIn server is established via the plugin. LinkedIn thereby receives the information that you have visited this website with your IP address. If you click the LinkedIn “share button” while logged into your LinkedIn account, you can link the content of this website on your LinkedIn profile. This allows LinkedIn to associate your visit to this website with your user account. We would like to point out that we, as the provider of the pages, have no knowledge of the content of the transmitted data or its use by LinkedIn. Details on data collection (purpose, scope, further processing, use) as well as your rights and setting options can be found in LinkedIn’s privacy policy at https://www.linkedin.com/static?key=privacy_policy&trk=hb_ft_priv.

Please also read our information according to Art.13 DSGVO.

Information regarding transparency and your rights

  • Legal basis for the processing of your personal data
The lawfulness of the processing of your personal data by our company is essentially based on the requirement of usage for a contract (Art. 6 (1) lit. b DSGVO), as is the case, for example, for processing operations that are necessary for a delivery of goods or the provision of another service or consideration. The same applies to such processing operations that are necessary for the performance of pre-contractual measures, such as in the case of inquiries about our products or services. Our company is subject to legal obligations by which the processing of personal data becomes necessary, such as for the fulfillment of tax obligations. In addition, we rely on explicit consents (Art. 6 (1) a DSGVO) to the processing of personal data relating to you, which you give us through a voluntary declaration. If a balancing of interests pursuant to Article 6(1)(f) DSGVO shows that our legitimate interests outweigh your rights to the protection of your personal data, the processing can be carried out on basis of this law. A legitimate interest may lie, for example, in the purpose of direct marketing according to recital 47 of the DSGVO. Thus, our legitimate interest regularly outweighs in the promotional postal processing of your data and the processing of your data for an address comparison that may be necessary for this in advance.
  • Right to information, correction, deletion, restriction of processing
You may at any time request information free of charge about the data we have stored about you or request correction, blocking and deletion of your stored data and its processing. If legal, contractual or commercial or tax retention periods or other legally anchored reasons prevent deletion, your data will not be deleted but blocked. For this purpose, please contact our data protection officer - in writing at: Thinking Networks AG, Data Protection, Markt 45-47, 52062 Aachen - by e-mail at: info(at)thinking-networks.com - or by fax at: +49 241 470 72 250.
  • Right of revocation
You have the right to object at any time to the processing of personal data concerning you. We will no longer process the personal data in the event of the objection, unless we can demonstrate compelling grounds for the processing that override your interests, rights and freedoms, or the processing serves to assert, exercise or defend legal claims. This right includes your right to withdraw any consent you have given us for processing under data protection law.
  • Right to data portability
You have the right to receive and transmit the personal data concerning you, which you have provided to us and the processing of which is based on consent or a contract and is carried out with the aid of automated processes, in a structured, common and machine-readable format. As far as technically feasible and provided that the rights and freedoms of other persons are not affected, you may request that the personal data be transferred directly from us to another controller.
  • Duration of the storage of personal data
The deletion of data takes place within the framework of the legal retention obligations and periods, taking into account the purpose limitation. The commercial or tax data of a completed fiscal year are deleted in accordance with the legal regulations after ten or six years, unless longer retention periods are prescribed or required for legitimate reasons. Shorter deletion periods are applied in special areas (e.g. in case of longer inactivity on your part). If data is not affected by this, it will be deleted when the aforementioned purposes have ceased to apply.
  • Right to complain to a supervisory authority
If you believe that the processing of personal data concerning you violates applicable data protection law, you may exercise the right to lodge a complaint with a supervisory authority.
  • Existence of automated decision making
We do not use your data for automated decision-making or profiling.
